The brand must be legally owned as removing access to the brand is all the power that is needed or available.
BUT are can be changed as the client likes but if they paint outside the bounds they are NOT still within the name franchize.
The franchize intellectual property is open source and can indeed be used in ways that do not meet the conditions/requirement of the franchize.
For me this is a mashup of GetHub and McDonalds franchise. In our case it is not about money but about reliable structures that get reliable results
